The attorney must be in tune with the criminal statutes in which their client is charged...

Ex: Defendants are often charged under the capital offense section 13A-5-40(a)(2) Murder by the defendant during a robbery in the first degree or an attempt thereof committed by the defendant...

1) The attorney must be aware that the prosecutor has the burden of proving that the robbery was in progress before the act of murder or that the murder was committed so that the robbery can take place.

2) If there is more than one defendant charged under this same offense section of the capital murder statute (making everyone codefendants), the attorney must know that neither client can be charged capitally, since there is no first degree robbery by law...
   13A-8-41 Robbery in the first degree
(a) A person commits the crime of robbery in the first degree if he violates Section 13A-8-43 and he:

(1) Is armed with a deadly weapon or dangerous instrument;  or

(2) Causes serious physical injury to another.

(b) Possession then and there of an article used or fashioned in a manner to lead any person who is present reasonably to believe it to be a deadly weapon or dangerous instrument, or any verbal or other representation by the defendant that he is then and there so armed, is prima facie evidence under subsection (a) of this section that he was so armed.

(c) Robbery in the first degree is a Class A felony.

   13A-8-42 Robbery in the second degree
(a) A person commits the crime of robbery in the second degree if he violates Section 13A-8-43 and he is aided by another person actually present.

(b) Robbery in the second degree is a Class B felony.

   13A-8-43 Robbery in the third degree
(a) A person commits the crime of robbery in the third degree if in the course of committing a theft he:

(1) Uses force against the person of the owner or any person present with intent to overcome his physical resistance or physical power of resistance;  or

(2) Threatens the imminent use of force against the person of the owner or any person present with intent to compel acquiescence to the taking of or escaping with the property.

(b) Robbery in the third degree is a Class C felony.

When there is more than one person involved in the crime of robbery, the violation is committed under 13A-8-42, Robbery in the second degree. 

Leaving that no person can be legally charged with capital murder under the offense section of the capital statute 13A-5-40(a)(2).

Similarly with the following offense sections under the capital statute:
13A-5-40(a)(1)
13A-5-40(a)(3)
13A-5-40(a)(4)
13A-5-40(a)(8)
13A-5-40(a)(9)
13A-5-40(a)(12)

The prosecutor bears the burden of proving that the aggravator in each of these offense sections were in process leading to the murder, or that the aggravator was connected to the murder, or that the murder was committed in the attempt of the aggravator, or that the murder was committed while the defendant was fleeing from the aggravator.

The prosecution had the burden of proving that the murder was gang related and was committed during a drive-by shooting, which makes the vehicle an actual instrument used in the murder.
Defendants in capital cases are routinely denied the right to effective representation by their attorney's failure to hold the state (prosecution) to their burden of proof.

Sad situation … Every time I saw Christopher Brooks, I offered him words of encouragement. For what it was worth.

 

The last morning I saw him, I had got word a short time before that he was crying …

 

This was on January 19th, 2016, the day in which he was transferred from his cell on the tier in which he lived on for years, to ‘death cell’ where he would live out his last days, leading up to his execution … Christopher was a silly guy, he joked a lot. Whatever man that the state arrested … - was surely not the man that the state killed.

 

However, society is not told of the changes in the Christopher Brooks that was executed. The man who would give you the shirt off his back if you were in need.

 

Christopher’s situation is also a testament to other guys on death row.

Congratulations to the State of Arkansas for having the courage to do away with their death penalty. The writing is on the wall, which speaks against the continuation of the death penalty in America.

Case after case where it has been a botched execution. Arizona, Oklahoma, Florida, Missouri, etc. But many states continue to choose to turn a blind eye to what’s really going on. Stop the shed of the blood seeking revenge in the name of justice!


Mr. Lockett was tortured, then killed. The State of Oklahoma has consistently fought to cover-up his murder. However, for those of us who oppose the death penalty, we will not allow his death, nor the rest, to be in vain.


The United States continue to murder the mentally ill in the name of procedurally barred clauses or in the name of the statutes that states  have drafted up that goes outside of the range of what determines a person to be mentally ill.


The only new way is to do away with this killing machine!

Anthony Ray Hinton has been freed from Alabama’s death row … Congratulations … 30 years wasted for a crime that he did not commit … That’s a major move for our movement against the death penalty!

Alabama has stated through former attorney general Troy King that, “Everyone on death row was guilty …” Well, that has been proven to be a lie! Thanks to God! But it was proven before … Wesley Quick, Daniel Moore, Gary Drinkard, Randall Padgett, and now Anthony Ray Hinton …

The change has come and now as a people we must continue to rise!

When is it right to kill a woman who acts in self-defense, after being perceived as defenseless. “Does one not see” Or does one see, but not care?” How can a woman be concluded as being a disgrace when she’s unwillingly taken advantage of by those not of her choice? Not of choice is, spoken of in the sense of one she chooses not to be with. However, I do acknowledge that there are women in relationships who are being ‘sexually’ taken advantage of, which is also not right.

Women are deserving of more respect. Women deserve to be thought of as being more than sex objects.

However, many forget that, “A woman is the reason for a man’s being … As it is that, a woman came from a man ...” Where would the nations be without the reproductivity of a woman? I’ll tell you where … We’ll be extinct with only the animals, and trees being existence.

We as a nation need to do more to protect the sacrecy of our women. Our nation as a government needs to do more to protect and preserve women of other nations. We as men have to do more to protect, serve and preserve our women while giving them more than reasons to have confidence in us as their man …

In the event when your circumstances becomes more important than your vision, you yourself have come to doom … For a person in such a state becomes of no benefit to others and destructive to themselves. Such a person lacks the intelligence to discern reality from falsehood. Giving in to an illusion, the mind gives way to recklessness causing separation among their closes peers and division amongst the grounds in which their feet tread. Only a snare awaits such a person which will overtake them in a sudden swift of the wind … Troublesome Is the right thing seemed to be, so in order to maintain the status in which they think they incurred, they go along with the crowd becoming a yes-man, even behind the back in which it’s given …

Interviewer:     Was there any other forms of killing that the Klan inflicted?

 

Interviewee:    Dam right it was. Sometimes Paw and Paw Paw would crack out the whip and skin the flesh off dem sum a bitches … Maken ‘em suffer right before they die. Sometimes the eye would pop clean out that motherfucker. They’d put quite a few of dem niggers to the blade … Especially those who had the tendency to try and escape off the plantation here… It served ‘em well, they had not gotdam reason to try and escape form us good white folks.

 

Interviewer:     You said, “This here plantation …” What plantation are you referring to? And why you feel that the African American had no reason to turn?

 

Interviewee:    Well, this here piece of land we’re sitting on use to be a plantation. My great and great great grandpaw’s use to won this land. After they died, it was past on us kids. Now, those niggers had no reason to run because they were well feed, had a roof over there head, and they didn’t have no bills to pay …

 

Interviewer:     Okay. How did your grandfather’s handle such rebellious African Americans?

 

Interviewee:    They were big on torturing them … often times torture led to their deaths. One from they had were cutting a hole through the nigger’s rib and sticking a hook clean through ‘em and hang ‘em by a chain with their hands bond until they died.

 

Interviewer:     How long did it usually take for them to die?

 

Interviewee:    Anywhere from three to eight days.

 

Interviewer:     Well, how did the Klan feel about the civil rights movement?

 

Interviewee:    Than dam king was the problem. He shoulda been killed when he was born … he motivated them niggers to break the law. We the Klan we’re against it and still are … However, though, when we saw we were losing leverage in the fight we had to reinvent ourselves and that we did … We came up with a new system.

 

Interviewer:     And that was?

 

Interviewee:    Politics … Plain ole politics. We drafted up laws that continue to carry out our goals … Our goals to exterminate niggers. Divide them, break up their homes. Don’t cha see it?

Interviewee:    Hell … We were the political platform that put most the politicians here in Alabama in office … Many of them are still there, holding down the fort. Ensuring our view are being carried out ….

 

Interviewer:     What is your thoughts on the death penalty and how it’s applied?

 

Interviewee:    Kill them all! They don’t deserve to live. All them niggers, kill ‘em!!!

 

Interviewer:     Wow, strong feelings … Well, what about the white people that are on death row?

 

Interviewee:    Kill them nigger lovers ... That’s what they get for following the path of them niggers … As far as how it’s being applied, hell, it’s alright by me!

 

Interviewer:     Well, Sir … Thank you for your time and straight-forwardness during this interview. That’s all that I have. Have a wonderful remainder of the day …

To my followers … I had more questions to ask but the more and more we talked, he became more and more aggressive in his speech as it related to African Americans. I thought I could sit through the interview unaffected, but I was wrong …


 

The Fight Is Not Over!

 

As I look around, out on this city, I see where we have come from, but just when we thought we made it … That’s when we stared breaking, then the past struggles became faded. Somewhere, someone must have forgotten to mentor the next boy or girl, man or woman to become the leader of the coming generation. Veils have been placed over the eyes of this present generation, in which has caused them to be misled. Their right to be free is being challenged with the passing of laws, which is directly aimed at keeping the revolving door to poverty, incarceration and self-destruction open for business on the communities of America.

 

When the so called leaders are faced with irrefutable evidence of a broken system that is screaming out to be fixed, they turn a blind eye and justify their wrongs until it’s them on the wrong side of the broken system.
(1) William Ziegler was released from death row in Alabama on August 15, 2014. Instead of the State of Alabama apologizing for the injustice which happened to him, they came to him with an offer of 18 yrs. just to keep a conviction in place for the sake of politics.
(2) Now, in the news headlines, Governor Rick Perry of Texas has been indicted on multiple federal charges. This is the same man who has issued death warrants for more people than any other governor in America, and the same man who has stated, “If other states can’t execute inmates, bring them to Texas.” Now, this same man, is claiming that an injustice is being done to him. What about the condemned inmates who has raised such claims of injustice???
(3) A young man in Missouri was gunned down by a police officer a couple weeks ago … something has yet to be done. The killing of this young man has been said to be justified. The young man posed no threat to the officer … he was unarmed, but yet he was shot in the face with his hands up. This killer is still roaming the streets of America as a free man …

 

Where do we go from here? Where do we go from here as a people? Where do we go from here as a nation?

 

I can’t answer such questions … However though, I do know that when we stand together as a people, as a community, and as a nation we will get to where we need to be …

Continuation of The Fight …

 

Back during the Civil Rights Movement a nation of people were educated about what was due them. Educated about what they deserved, what their rights were, and how to fight. Leaders rose up and took the initiative to leas this nation of people to where they needed to be … They took this nation of people to a whole new platform. Those leaders laid down their lives for the people of this nation to have freedom and respect, for the people of this nation to have equal opportunity, to have a voice of their own … All of those leaders died violent deaths. Now, today we see so called leaders standing by, in high places, watching as the sacrifices of the past are being disrespected … until a camera pops up. Of course, however, though, we as a community should not lay and wait for them to stand up for us when we have the ability to stand up for ourselves. The Civil Rights Movement was successful, because they were hands-on with the community. So, to all the people in California, Ohio, Missouri, Florida, New York, Arkansas, overseas and else where who are standing up and standing out as protesters against the injustice that’s being done to the citizens, I salute you all, I stand and protest with y’all in spirit. Continue to fight … continue to be stronger … Don’t ever get tired of fighting.

“Unspoken Words”

 

Unspoken words, may the silence speak. My pain is concealed, however, my expressions are emotional and something the world can feel. Instructions are taught, but a demonstration is seldom showed. As the world goes round, the world grows cold --- The story of a lost soul. The earth is shaking and I need solid grounds beneath my feet. Hat low, as though, I’m unseen. No one to give correction, so I watch quietly as the storm leave. Shackles and chains, I see that it’s mind is misleading. Temporary satisfaction, but it ain’t pleasing … Now, I’m believing that if the nugget is dropped it won’t get caught, so lost in thoughts the brain isoperating without no reason. Conscious of nothing now it lay. A ship at sea is a ship in damage so to play safe I’m at bay. A fool learn from experience, but rather wisdom comes from what others have experienced.
So, pay attention to the unspoken words that fills the atmosphere. Lean not to your own understanding, but God’s – then to you the water will remain clear …

This is how it began for many in the ‘hood’ areas of ‘Ghetto America’. Children facing such adversity in their local life, the streets and those in them … Is this wrong? No. I say that because the way that is taught is the only way they know … They too, like the ones being taught, came from broken homes, up in rough environments, and with no guidance. So, all they come to know is the course in which they take.

My judgment became cloudy and my thinking was disturb. Help me Lord, I need you, I’m nothing without. I need you to move on my behalf, quick fast, and in a hurry … Right now!!!

 

Thank you heavenly Father for hearing my cries for help, for moving out before me and paving the way for which I shall travel; for blessing this day and all that it produces; for blessing me with victory over my enemies and adversaries; for reuniting me and my family together; and keeping your shield and protection around us …

 

God is full of compassion and mercy, love and undeserved kindness.

Give Me Back My Son

 

Give me my son back ...‘ ‚Why should I give him back? Why don’t you just join us and share in all that we’ve built from the ground up while you were away?’ ‘Nawl, I’m good. I can do without your pleasures, I just want my son.’ ‘What has gotten into you … I remember when we started this organization. I remember the work you put in, we put in while laying the foundation of this operation …’ ‘I remember too … I remember the fool I was, the fool we all were, the lack of guidance we had, the ignorance we prouded ourselves over. I remember all of that; I don’t need no reminder. I don’t identify myself with that way of thinking anymore. However, I  do identify myself with the son that was born to me in the midst of my troubles, which is why I’m here to claim what’s rightfully mine.’ ‘You just think after 10 years, you can just walk up in my establishment and make these crazy demands!!! Well, I got news for you … This here life is blood in blood up … your son is the son of this here establishment, and I say he ain’t going nowhere with you!!! Big Hurt, lock the door!!’ ‘Man look, it doesn’t have to be like this … I’m just trying to be to him, my son, what we always wanted. We turned to the streets as a default to fill the void in our lives. He no longer has that void. I’m no longer absent. I’m no longer ignorant. I’m here now. You have what you want, so please let me walk away with what I need. I don’t want him to hurt no more than he already has been by m absence. I made a vow to God that with the ability that He has bestowed upon me, entrusted me with to be a better man.’ ‘Well, That was a good speech, but if you think for one second that you walking outa here with this boy, you’re just a lie. The I’m Feeling 

 

Woke up this morning feeling negative … How can this be reversed into a positive? Don’t know, but by sun down I will have found out.

 

What will come forth I’ll view from a spiritual perspective so that I may understand the why of it all.

 

Looking out the bars of this cell I have been reduced to, I see nothing more than the small minds bickering over small things.

 

How can one give up on himself, when himself is all himself has? You don’t know? Well, me either … I see no unity. I see no hope, I see suppressed frustration. I see depression. All of this, when I look into guy’s faces.

 

So, my negative awakening comes from wanting these guys to have same focus I have. The same hope I have. The same joy, and peace I have. Now, don’t mistake the two negatives to be the same … Because I still feel ‘some type of way’. However, I know the positive is in view, and understanding is on the way …

Fair Trial 

 

Allegedly a defendant is “innocent until proven guilty” … Really? Anyone who has had an encounter with the criminal justice system knows the truth … A defendant is “guilty until proven innocent”. If the first was the truth, then Ray Hinton wouldn’t have had to spend 25 years on death row, Gary Drinkard would not have had to spend years on death row, Daniel Moore would have never been arrested …Jimmy Dill would have never been executed.

 

Some system, huh? The United States Supreme Court has actually said, “A defendant is entitled to a fair trial, but not a perfect one.” How can a trial be deemed fair, when imperfection is ever present? The prosecution continues to withhold evidence, introduce perjured testimony, and present inadmissible evidence … in every (almost every) trial.

 

The United States Supreme Court went on to say, “for there are no perfect trials”. How can a reasonable person (judge, prosecutor, police, etc.) continue to allow trials to be tainted by the intentional imperfection caused by individuals who suppose to ensure that a trial is fair?

 

I think, a good solution would be to, start charging prosecutors with attempted murder, when they falsely accuse, wrongfully convict and wrongfully sentence to death, an innocent man (person) …And, charge them with murder when one is executed!

BACKGROUND

 

Life is given, then immediately taken … How so? Many may ask, well through poverty, drug and gang activity. Dysfunctional household forces kids to grow more toward the streets, embracing them, then being overtaken by them.

 

Communities were erected to further impoverish a selected group of people. The goal of this project was to keep the puppet masters’ control over the people who were considered (to them) puppets. The puppets from what they considered to be treasure, they could control their mindset “… Their way of thinking”. Instead, the puppets exhibited unity. Coining the philosophy “It takes a village to raise a child.” At the sight of this, the puppet master responded by “Allowing narcotics to flood the communities of the puppets”. So, the puppets coined another philosophy “each one, teach one”. At this, the puppet master responded by “Turning the puppets way of thinking against each other”. Since then, the puppets have been “crabs in a bucket” … 

 

Setting death traps for one another … They became “territorial”, destroying the gold mine of themselves.

“Collegeville is a virtual island of poverty”. Collegeville was intentionally created to be isolated from the rest of Birmingham, Alabama. “In 1926, a zoning overlay was done up … to, in essence, really lock in industrial uses and housing for Negros”. Approximately twenty rail road crossings separate Collegeville from the rest of Birmingham. 

 

Collegeville is also the subject of an ongoing environmental investigation. Recent tests conducted by the United States Environmental Protection Agency (EPA) revealed soil and air contamination above levels of concern. U.S. Environment Protection Agency, Information Sheet: Riggins School, Birmingham, Alabama (May 2011). The chemicals of concern are arsenic and polycyclic aromatic hydrocarbons (PAHs). The soil was collected from the school yard of Riggins School. Riggins was selected, because it is located very close to Walter Coke’s coal raw material piles and coke ovens. Children must be kept away from contaminated areas.

Turning of Tables

 

Stop … Do not pass go … you shamed the people. Your pride has been profaned, your honor is humiliated. Ray Hinton shall not die, but live. The state courts have denied this man 25 years of his life, 25 years they can’t give back to him. Ineffective assistance of counsel is what he received before, and during his trial. The state courts saw this years ago … But failed time and time again to correct it. Let them tell it though, they reviewed his case for “plain error”, but there wasn’t any ... really!!! Now, the United States Supreme Court has concluded that, Anthony Ray Hinton’s trial counsel was deficient in failing to investigate (research) state law to determine how much he could receive from court (trial court), in the amount of funds, to obtain a competent expert in “toolmarks and ballistics”, instead of calling as a witness an incompetent and unqualified retired civil engineer who specialized in heavy artillery during his time spent in the military around World War II. Society prides itself on doing the right thing; well, the right thing supposed to be done years ago. Now, the Court of Criminal Appeals must determine whether or not Anthony Hinton was prejudiced by his trial lawyer’s deficient performance. How was he not prejudiced by his trial lawyer’s mistake/failure? The state theory was that the weapon taken out of Anthony Hinton’s mother’s residence was a match to the bullets that were recovered from the two deceased victims that were killed during a similar robbery. The third (3rd) victim was shot, but not killed … The third (3rd) victim allegedly identified Anthony Hinton as the assailant who attempted to kill him when he was robbed … However, Anthony Ray Hinton was never charged nor tried for the crime in which the third (3rd) victim allegedly identified him. But, the state used the above to convict Anthony Ray Hinton.

Funny, huh?

This is justice in America.

But now, the tables have turned!!!

I’ve come a long way in my spiritual walk, and still I have a long way to go. The intentions of my heart is pure, my actions are contrary to those who don’t understand me, to those who don’t know you.

Jehovah, I’m too close to the mirror to know my every weakness. The one’s you have revealed to me, I by your grace and mercy through your son Jesus and my Lord and savior, work toward bettering. Therefore, I walk with my head down, not because of depression … But, because I choose to remain humble before you.

 

Though innocent, I thank you for allowing me to discover the jewels in my affliction. As I look and see those who don’t believe, don’t trust, don’t depend in/on you, and don’t apply themselves I respond with compassion. My response is with selflessness.

 

However, though in my walk I still fall … But, I don’t stay down, I get back up ask for forgiveness, work toward repentance …

 

Sometimes my shortcomings are intentional, sometimes my shortcomings are unintentional.

 

For I was born in error, I was conceived in sin.

“Untitled”

 

Over the years God has been cultivating me… The seed that was planted in me back in 1992, has now sprung forth. However, that seed dwelled within me for years; as its roots had to first grow downward into the depths of my soul so that the seed may be firmly established.

 

As the years progressed, the more trouble my eyes came to see. Though I felt alone; God was there, cultivating and watering that seed. In the midst of the storm, I contemplated (…????). The stem of that seed stared to sprout up, as soon as I saw it, “I cut it down”. However, the stem from that seed never failed to sprout … In fact, it did so so much, ‘til I just stopped cutting it down … I allowed that seed to grow, and as it did, I no longer was shaped by life’s circumstances. That seed began to produce fruit(s) … Among them were: compassion, knowledge, understanding, wisdom, accurate loyalty, accurate love, accurate dedication, accurate respect, accurate unity, accurate honor of God. Through it all, a MAN was GROWING and DEVELOPING. A DESIRE was being stirred up. The growth of that seed has allowed me to see thing from a new perspective. The chains that once kept me mentally incarcerated have been broken. The chains that once had my spirit impoverished have been released. “God has humbled the MAN so that he may become a MAN.” A fool says that, he or she will learn from experience. The wise say that, he/she will profit from other’s experiences.

 

Foolish:           Hey wisdom, what cha think ‘bout being her at this cross-road?

 

Wisdom:         Well foolish, I don’t … I’m just going to turn onto the intersection.

 

Foolish represents the one who operates through worldly wisdom … Wisdom represents the one who operates through the spirit …

“Growth that’s Developed, But Became Lost.”

 

See,

 

Growth and development is for everybody, but not everyone makes that decision to grow. The saying of one with wisdom goes “You peep a fool by letting them show their hand(s) …” You have to be from the old school to grasp the riddle or from the new school with old school values to understand it.

 

Thanks be to God, the sharpness of my growth and development derives from the poverty in which I lived, which taught me how to be and remain humble. The sharpness of my growth and development was molded by those who were older than me. I hung around with guys who were older than me (women too), who taught me how to survive the struggles and strains of life and how “I would only be unsuccessful only if I thought and believed that I would not succeed.”

 

The new generation, I see, only grow with their growth being negative. Not all but most … The mentality that they have is unrelatible. Their thought process of oneself is of disrespect, not only of themselves, but other as well. I’m oppressed, I’m poor, I’m going to take from others because I’ve without, I’m going to bully someone so that I may feel good, I don’t have no one to help me. This is their way of thinking. This is what their environment teaches them.

 

Guess what though? The very entity that professes their goal to reduce crime knows of the new generation’s shortcomings. However, instead of working toward bettering this new generation, they eagerly strive toward creating new laws to ensnare them, keeping them trapped in a devastating way of thinking, acting and living … The do this because they know that without crime it’s hard to politic …

 

Criminal acts are not racist nor prejudice: Just the way the consequences are applied to who commits the act …

Though, the state is pressing to pass the “Un-Fair Justice Act”, God continues to show the nation that “eye for an eye” is not the answer to the problem. Mr. Anthony Ray Hinton is on the brink of a new trial and exoneration … On top of that, the state has recently admitted that they have no drugs to carry out an execution.

 

How can people be so blinded? How can they not see that “homicide for homicide” is an act of revenge and not justice? When Don Singleman found himself on the other side of the law, quickly realized the unfairness of what they call justice in Alabama. Hs family too … I guess, it takes for one to experience it first, before they can see it.

 

Now, if Alabama pass this “Un-Fair Justice Act”, which is highly likely, what will they do next when guys get just as much relief under the new system?

Life And Lesson

 

Life is a beautiful thing. You live, and you learn. Helping those who help themselves is a pleasure. Just as, when you cut loose those who are not trying to help themselves. “The only way to peep a fool is to let him show his hand.” Once you begin to play our hand close to your heart, your eyes begin to open and see who are your friends or foe.

 

Alabama has acted foolish with the presentation of these new bills concerning “capital offense” collateral appeal process. They’re only doing this in an effort to prevent further shame from being brought upon the state. It’s easy to see, every time Alabama highlight these bills in the media, they attach them to the 5 cases that have been reversed in collateral appeal (rule 32) in the past 3 or 4 years… Despite of the unfairness and wrongness of the death penalty system in Alabama they work hard to make it more defective at the expense of victim’s families emotions.

 

Even further more Anthony Hinton just got a remand from the U.S. Supreme Court, (in laymen terms) instructing the Alabama courts to do the “Right Thing”. We all know though, that Alabama would rather have another court to correct their wrong, because Alabama prefers to put INJUSTICE and POLITICS first …

Interviewee:

Good Morning Ma’am. I’m doing fine, how about yourself?

Interviewer:

Fine. Thank you for asking. Well, I’m an investigative reporter for Just-us v. Alabama, and I’m here to do an interview with you concerning the death penalty. Please, will you state your full name, age, and status?

Interviewee:

Yes. My name is Randy Lewis. I’m 27 years ol. And, I’m an innocent man on Alabama’s death row.

Interviewer:

Okay, you say that you’re an innocent man … Interesting, because, if I asked, I’m sure that most of the guys on death row would say the same thing. Without going into details, will you explain your assertion?

Interviewee:

Well, it’s hard to explain without going into details, so I’ll just let that rest. However, I will like to address something you said … If you ask guys on death row “whether or not they’re innocent” you’ll get a mixture of answers,

Interviewer:

Such as …

Interviewee:

Allow me to finish. Such as “some would say they’re innocent, some will say they’re guilt but not of capital murder and some may say they’re guilty”. As you may know these who say they’re guilty request dates, execution dates by dropping their appeals.

Interviewer:

Would you name a few?

Interviewee:

Those who are already dead; yes … Parnell Ford, Christopher, ah, ah, what’s his last name … Forgive me, I can’t think of it right now. Also, Andrew Lackey.

Interviewer:

Why those who are already dead?

Interviewee:

Because I’m against the death penalty …

Interviewer:

Have you always been against the death penalty?

Interviewee:

No … It’s hard to be against what you have or had no knowledge of …

Interviewer:

Ummm … No knowledge of … Well, do you think that the death penalty has been applied equally and fairly?

Interviewee:

No. Most of the people who are on death row are indigent and come, or came I should say, from low income and impoverish communities. And, politics plays too much of a role in who and who doesn’t get the death penalty. If the foundation is rotten, how can anything that’s build on it make it, right?

Interviewer:

Politics playing a role in who and who doesn’t get the death penalty, how so?

Interviewee:

For starters you can view the number of death sentences handed down during election year. Also, politicians play on the family of the victim’s emotions to gain favor with the voters. Just look at what they’re calling the “Fair Justice Act”. It’s not fair at all. They’re just trying to prevent new trials from being rightfully obtained and innocent men (people) from being exonerated. Over the past 3 years 5 men have obtained new trials. 2 declared innocent by trial judge, 1 for Brady violation by the prosecution, 1 juror misconduct, 1 for ineffective assistance of counsel. Hard for the State of Alabama to explain how and why these men (which there are many more) were convicted in the first place by the DA. Unconstitutional tactics.

Interviewer:

In the beginning was the end. However, later it was manifested in the earth through the product of the creation. As eyes look up and see, the end steady approaches. The end to what? Well, you know … so, face it, prepare for it, be ready. Daily portions are shedded as I strive toward that ending which is desperately desired. I dream and have visions about.

I prayed and continue to pray for it to manifested now, in due time. So much, so much, I see. Me, a wife, kids, a family. Established and stable, carefree just enjoying life. It’s peace, a place without violence, verbal nor physical, but all living in harmony.

Encamped about me are like minded ones who’re on no foolishness, with no false steps in their paths.

Interviewer:

Mr. Lewis, is that all? You know, if there’s more you can share it with me.

Interviewee:

Yeah, I know, but other than that I’m just on my G.M.S. … uprooting from within me, what I no longer identify myself with. Growth and development is key to my progress, I thank God daily for it. At times, I get side trucked with other things, but I lace my puma’s back up and get back on track. My situation is heavy but God, through Jesus has made it light. This is the pressing place, which brought to an end my old way of thinking and introduced me to God’s humble beginning … Though innocent, I don’t reject nor neglect the lesson that’s revealed through this situation. God’s plan is now in vision and His purpose in vivid view.

Randy Lewis arrives at visitation room for continuation of interview at 8:30 am … We now commence the interview by picking up where we left off.

Good morning Mr. Lewis. How are you doing?

Interviewee:

By the Grace of God, I’m doing well, and how about yourself?

Interviewer:

I’m doing fine … Thanks for asking. Mr. Lewis, I will like to pick up where we left off, which is where you began to explain to me the process in which wrongful convictions come about and how the district attorney plays a role in that … However, I would like to ask about the event that happened, which in turn cut our interview short.

Interviewee:

Yes, about that … hhmmmmm. Well, a guy in general population had a heart attack on the basketball court and died. Just this past weekend another guy had an attack and died also. So, that’s what that was about.

Interviewer:

Heart attack, yike’s … Sorry to hear that.

Interviewee:

Yeah. It’s sad.

Interviewer:

Yeah, yeah; well, let’s pick up where we left off.

Interviewee:

Ok. … Well, it all starts at the initial investigation process. During the initial investigation stage police officers speak with witnesses to the crime. Those witnesses give their account of what happened, what they observed. While the officer(s) take notes and fill out police reports. Once that process is over, the information collected by the officers are turned over to the homicide detectives. The homicide detectives follow up of the information collected which is often called a “preliminary investigation”. During the course of that time a suspect is developed. Sometimes one isn’t. However, in such cases where there’s a suspect, he or she are located, arrested and then interrogated.

After that the suspect is taken into custody. Now the suspect can be the right or wrong person. In cases where the right suspect is in custody, the evidence, physical and circumstantial, links him or her to the crime. In majority of those cases the suspect accepts a plea deal. In cases where the suspect is innocent. Homicide detectives tamper with evidence to make it fit the innocent suspect. Most cases like this, the district attorney (assistant district attorney) has knowledge of what’s going on. Instead of correcting this grave injustice before it gets worse, they allow it to continue and defend their actions. That is how innocent people are convicted.

Interviewer:

Ahh … That’s interesting. You to tell me that public officials will go to that extent to obtain a conviction?

Interviewee:

Of course they do. It’s all political. They blind the people with fabrication, make the city look good, they get a promotion … Now don’t get me wrong, it’s not all the time that this happens, however, it does happen a lot.

Interviewer:

Okay, what does it look like for the death penalty in general?

Interviewee:

Right now the death penalty is a hot trend because of what’s going on with the lethal injection drugs and also what’s going on with the exonerates …

Interviewer:

Drugs … What’s going on with the drugs?

Interruption:

Don’t mean to barge in on you guys, but umm, I’m checking to see if I could get y’all anything … coffee, water, snack …

Interviewer and interviewee:

No, but thank you kindly.

Interviewer:

Wow, same words at the same time …

Interviewee:

Yeah. Okay, the problem with the drugs that’s being used in the execution of American citizens is simple: Pharmacies have been exposed for playing a role in the death of the who they gave an oath to save if need be. And now they want to, or should I say, now they’re withdrawing from supplying the drugs.

Interviewer:

And the exonerates?

Interviewee:

Well, it’s nationwide. However, in Alabama you two men whose collateral judges have declared them innocent, but the state is still fighting their cases. Politicing. But that’s how the game is play, public officials are moved by the people’s majority and not by right thing. Alabama has 3 more innocent men whose cases are about to attractive attention to Alabama’s judicial system in a negative way.

Interviewer:

Do you think the death penalty will be done away with?

Interviewee:

In due time it will come to pass however, the foundation has been laid and the rock is chipped away at.

Interviewer:

Well, Mr. Lewis, I want to thank you for our time and consideration.

Progress At The Expense of Your Sacrifice

 

 

More that I find myself helping someone at the bottom rise to the top, the closer I find myself to the bottom of the pile … This revelation is interesting, don’t you think? It is interesting because one would think that, a reasonable person who is given a hand up from the bottom would throw what to do once they reach the top, even more interesting is this: “When a person is given a hand up from the bottom, but jumpship quarter ways (thinking quarter way in the top) and expect to receive the same reward as the person who endured to the end.” With this (help others), I felt that I was making progress … But came to find out, I wasn’t. Now, parallel this to what the state of Alabama is now doing: “Cutting the appeal process of collateral appeal in death penalty cases”. Alabama claims this is the “Fair Justice Act”. How far is it though? Truth be told, Alabama just want the advantage of control and guarantee what the end should be “Death without Due Process”. In the last 3 years, 5 death row cases have been reversed. 2 involve cases in which the trial judges said, “The defendant was innocent.” The judge found that, “The prosecutor withheld exculpatory evidence from the defense.” The judge found that, “A juror was untruthful in the jury selection process.” The last one involved, “ineffective assistance of trial counsel.” This is the truth … This is what Alabama wants to prevent from happening.

The Department of Corrections is presumed to rehabilitate a person. However, that’s not what it does … What it does is, set a person up for re-entry into a world that was “erected” to right the wrong of a person. To teach the person a skill to survive. To help the person discovery the talent, in which they possess, to help them make it. To educate the person, which will better them for re-entry into the world they long to return to and remain in … The Department of Corrections has become a waste fill, in which they cast the lost souls of humanity with no hope of survival. How can D.O.C. reasonably expect for a child to know what’s right when all the child is taught is wrong? How can you expect for a man to contribute to a society that he’s been totally locked out of? When released from prison a person is not only labeled a convicted felony … But that person becomes homeless, jobless and to say the lease … POOR! He or she become these things because of the laws that the government has passed, which makes it extremely difficult for the person to rise above their circumstances alone …
