  • Specifically the PRESIDENT OF THE UNITED STATES, THE HONORABLE BARACK OBAMA, AND the ATTORNEY GENERAL; ERIC H. HOLDER, JR c/o United States Justice Department

  • You may or may not know of recent Order by PRESIDENT OBAMA for the JUSTICE DEPARTMENT to investigate capital punishment in U.S.A.

  • This is my PERSONAL HUMBLE PLEA FOR YOU “THE COURT OF PUBLIC OPINION” to make your individual voices heard and DEMAND THAT INVESTIGATION NOT BE SMALL – NARROWED TO ONLY A COUPLE OR FEW AREAS OF CAPITAL PUNISHMENT

  • DEMAND the spotlight – FOCUS be on the STATE OF ALABAMA – MY CASE IN PARTICULAR!

  • PERFECT EXAMPLE – At this writing I have NEVER had a full in-court review of EITHER State Rule 32 OR Federal Habeas Corpus – both the most critical levels of appeals

  • I’ve been on Death Row since May 1983

  • I’ve had 5 five separate execution dates

  • I’ve been in a court room for what was supposedly 3 three so-called trials

  • 1983 – 1987 – 1991 – My court-appointed attorneys admitted had no background in capital punishment law – (which differs greatly from criminal law)

  • Last so-called attorney at 1991 trial picked a juror because he had a nice tie on!!

  • All court-appointed attorneys for capital cases up until 1999-2000 in Alabama were only aid $1,000 – yes, one thousand dollars fee, and only $40 yes, forty dollars an hour in court. All monies stopped cut-off at $3,000 three thousand dollars – to prepare and present a Death Penalty case!!

FACT I am absolutely innocent and my attorneys who came on my case 2001 can prove it.

  • But have been totally blocked from doing so BECAUSE of a 1996 Federal anti-terrorist law created to keep terrorists from dragging out appeals

  • That law put time limits to appeals in terrorist crimes

  • State Attorney Generals have gotten away with blocking State appeals with that time limit on filing appeals

  • I did not have an attorney at all when my time limit was going on!!

  • I had never had a Private Investigator to look for eye-witnesses that put me 75 seventy five miles away from crime scene at the time the crime was committed

  • Those witnesses have been verbally intimidated by State – even implied their State tax be audited

  • Until my attorneys now came on my case 2001 – there had been zero – none testing of evidence on my behalf

  • In 2010 a so-called judge reluctantly allowed a tiny bit of evidence to be DNA tested. Test showed I was NOT at crime scene

  • Beyond belief that so-called judge flat refused to even allow my attorneys to pay for more advanced new type DNA testing of that evidence

  • Let me expand on that so-called judge at that same hearing – she also flat denied – REFUSED to allow the State DNA Forensic Department Head to test NEGRO HAIR in the evidence box (I AM CAUCASIAN)

  • NOTE This refusal done in spite of irrefutable facts State’s key (only) witness gave 7 or 8 sworn written statements and testified at her own trial 1982 under oath a BLACK MAN had beaten her – raped her and killed her husband who was CAUCASIAN (HER AND HER HUSBAND)

  • The NEGRO HAIR was found at crime scene and in car supposedly used by killer

  • This key (only) State witness also stated in those 7-8 sworn witness statements AND in front of her own trial jury under oath “Tommy Arthur had nothing to do with the murder of my husband”!!

  • But after she was sentenced to life in prison and her appeal attorney, who was almost certainly going to be elected as District Attorney – offered her a deal to get out of prison early IF she changed her 7-8 written testimonies AND her testimony at her own trial

  • She suddenly appears at my 1987 trial and beyond all belief was allowed by a so-called judge to say “I was lying all them other times but I aint lying now – I paid Tommy Arthur to kill my husband”!! Yes, that’s Alabama justice

  • By the way, a man has confessed under oath in a Court room and in a sworn written statement he killed the victim in this case

  • That same so-called judge who flat refused to allow the aforementioned DNA testing – would not give my attorneys the paid liars the State said passed notes between that man and me that judge withheld the names until 30 minutes before the hearing – blocking my attorneys from securing log records

  • Those log records kept by the officers who operate electronic gates (only entrance) to Death Row at Holman Prison

  • Those log records show specifically who and why those gates are ever opened by those officers

  • POINT – FACT Those log records would have shown the State’s witnesses were blatantly lying Period

  • The behavior of that so-called judge should be investigated by the United States Justice Department

  • Proof irrefutable in transcripts of Judy Wicker 1982 trial my so-called 1983-1987-1991 trials the State entrusted required by State – Federal laws to keep-secure-any all physical evidence connected to a capital punishment (death penalty) case repeat State’s crystal clear duty to secure all evidence – court records show either flat taken out of the evidence boxes and/or admitted destroyed or lost by State of Alabama in Thomas D. Arthur case

    • Bed clothing (sheets, pillowcases, blanket, bed-spread)

    • Rape kit – yes, rape kit taken of Judy Wicker

    • 20 twenty $100 dollar bills (one hundred dollar bills) State said Judy Wicker paid Thomas D. Arthur were sent to FBI fingerprint lab for Judy Wicker prints. Found none. BUT DID NOT TEST for fingerprints of Bruce and Regina Caroll married couple who testified in court under oath they had lost 65 (one hundred dollar bills) $6,500 to Thomas Arthur in a poker game.

  • After the trial for the death of victim Troy Wicker State took those 20 $100 dollar bills out of Thomas D. Arthur capital punishment death penalty case and bought, yes went to store in Decatur, Alabama, and bought a TV satellite dish for the Department of Correction Decatur Work Release

  • Numerous other devious illegal tactics by staff such as not mentioning so-called purchase of a specific 22 Magnum 22 caliber bullets supposedly used in death of Mr. Wicker – the owner of a night club owned a 22 Magnum pistol the girl who had her boyfriend buy said bullets worked for, and actually had bought said bullets for her boss at the night club who owned a 22 Magnum pistol

  • Other totally outrageous incidents too numerous to try to list

  • Clothing of State’s key witness Judy Wicker have never been tested for gunshots residue

EXAMPLESwhy United States Justice Department should conduct complete review of Thomas D. Arthur case asap

 

IN CLOSING, ASK YOURSELF THESE 2 TWO GLARING QUESTIONS

  • FIRSTHow on this earth can there be NO TIME LIMIT on charging a person with a death sentence crime, YET have a time limit on proving innocence or ineffective assistance of attorneys doing trial?

  • SECOND During this age of political correctness AND the focus on races!

  • What if I were African-American? And the hair in evidence box was Caucasian hair? Can you imagine the outcry – the demonstration on the very steps of the United State Supreme Court steps Capital too? For that hair and any all physical evidence not lost – stolen – destroyed by State be completely DNA tested – all testing known to science

Although a federal judge recently ruled Tommy Arthur's stay of 2012 remains in place, we kindly ask you to send letters to Alabama's Governor Bentley and the Senators to plead to grant clemency.
